Rubbish Removal Docklands Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Docklands provides rubbish removal, waste collection and associated services to residential and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting the services.
Company means Rubbish Removal Docklands, the service provider.
Services means any rubbish removal, waste collection, clearance, loading, transportation or disposal service carried out by the Company.
Waste means any materials, items, rubbish or refuse that the Customer asks the Company to collect and remove.
Site means the property, premises or location where the Services are to be provided.
2. Scope of Services
The Company provides rubbish removal and waste collection services, including loading waste from the Site, transporting it using appropriate vehicles, and disposing of it at licensed facilities in accordance with applicable waste regulations. The exact scope of the Services, including the type and volume of waste, access arrangements and any specific instructions, will be confirmed at the time of booking or upon arrival at the Site.
The Company reserves the right to refuse to collect any waste which it reasonably considers to be hazardous, prohibited, unsafe to handle, or not accurately described at the time of booking. The Company also reserves the right to adjust the chargeable amount if the volume, type or weight of waste differs from that initially quoted.
3. Booking Process
Customers may request a booking by telephone, email or online enquiry. When making a booking, the Customer must provide accurate and complete information, including the address, access details, type of property, approximate volume and type of waste, and any special requirements or restrictions.
All bookings are subject to availability and are not confirmed until the Company has accepted the request and provided confirmation, which may be by email, text or verbal agreement. The Company may provide an estimate based on information supplied by the Customer. This estimate may change if, upon arrival at the Site, the waste is found to differ from the description provided.
The Customer is responsible for ensuring that a person aged 18 or over is present at the Site at the agreed time to grant access, confirm the work to be carried out, and authorise any changes to the scope of the Services or the price.
4. Access and Site Conditions
The Customer must ensure that the Company has safe, reasonable and unobstructed access to the Site and to the waste that is to be removed. This includes providing any necessary keys, codes, permits or authorisations to enter the premises, and ensuring that any parking or loading restrictions are addressed in advance.
The Customer is responsible for securing any parking arrangements required for the Company’s vehicles. Where parking charges apply, these may be added to the final invoice.
If the Company is unable to access the Site or the waste due to circumstances within the Customer’s control, the Company may charge a reasonable call-out or waiting fee, or treat the booking as cancelled by the Customer.
5. Customer Responsibilities
The Customer is responsible for:
Ensuring that all waste to be collected is clearly identified, segregated where appropriate, and accessible.
Informing the Company in advance of any hazardous, clinical, electrical, liquid or heavy items, or any other materials subject to special handling or disposal requirements.
Obtaining any required permissions from landlords, building managers, neighbours or local authorities that are necessary for the Company to carry out the Services.
Ensuring that the Site is safe for the Company’s staff to work at, including providing clear access routes, adequate lighting, and alerting the Company to any known risks or hazards.
The Customer must not request the removal of any items that do not belong to them or that they are not authorised to dispose of.
6. Estimates, Quotes and Pricing
Any price indication provided before the Company attends the Site is an estimate only, based on the information given by the Customer. The final price will be confirmed on arrival, after assessment of the actual volume, type and weight of the waste, the time required, and any additional factors such as difficult access, dismantling, or extra labour.
All prices are stated in pounds sterling and, where applicable, are inclusive of any relevant taxes unless stated otherwise. The Company reserves the right to revise its rates at any time, but changes will not affect bookings that have already been confirmed, except where the scope of the Services has changed.
Where the Customer requests additional work or there are factors that could not reasonably have been foreseen at the time of the initial estimate, the Company may agree revised pricing with the Customer before proceeding.
7. Payments and Invoicing
Unless otherwise agreed in writing, payment is due in full on completion of the Services, before the Company’s team leaves the Site. Payment may be made by cash, card or other methods accepted by the Company from time to time.
Commercial Customers may, at the Company’s discretion, be offered account terms. In such cases, invoices are payable within the period specified on the invoice. If payment is not received by the due date, the Company reserves the right to charge interest on the overdue amount and to suspend further Services until payment is made in full.
The Customer is responsible for ensuring that funds are available and that payment details provided are correct. If a card payment is declined or a bank transfer reversed, the Customer must immediately provide an alternative method of payment.
8. Cancellations and Changes
The Customer may cancel or reschedule a booking by giving reasonable notice. The Company recommends that the Customer provides at least 24 hours’ notice where possible.
If the Customer cancels within a short period before the agreed time, or if the Company arrives on Site and is unable to carry out the work due to reasons within the Customer’s control, the Company may apply a cancellation or call-out fee to cover costs incurred.
The Company reserves the right to cancel or reschedule a booking in the event of circumstances beyond its control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness, safety concerns, or regulatory issues. In such cases, the Company will seek to provide as much notice as reasonably possible and will offer an alternative appointment. The Company will not be liable for any losses arising from such cancellation or rescheduling.
9. Waste Regulations and Compliance
The Company operates in accordance with applicable UK waste management legislation and guidance. All waste collected by the Company will be transported and disposed of only at licensed and authorised facilities, and appropriate records will be maintained in line with regulatory requirements.
The Customer must not present for collection any waste that is illegal, hazardous, explosive, radioactive, clinical, chemical or otherwise subject to special controls, unless expressly agreed in writing in advance and in compliance with relevant laws. Prohibited items may include, but are not limited to, asbestos, gas cylinders, solvents, oils, medical waste, and certain electrical or electronic equipment.
If the Company discovers that the waste contains prohibited or undeclared hazardous materials, it may refuse to remove such items, adjust its pricing to reflect additional handling and disposal costs, or require the Customer to arrange alternative specialist disposal. The Customer will be responsible for any fines, penalties or claims arising from the misdescription or improper presentation of waste.
10. Title and Risk
Ownership of waste passes to the Company once the waste has been loaded onto the Company’s vehicle and full payment has been received. Risk in the waste passes to the Company at the same time. Until that point, all waste remains the responsibility and property of the Customer.
The Company is not responsible for any items that the Customer did not intend to dispose of but which were mixed with the waste or otherwise unclear. The Customer must check carefully before the waste is removed that no personal possessions or valuables are included. Once removed and loaded, items may not be recoverable.
11. Liability and Limitations
The Company will exercise reasonable care and skill in providing the Services. However, the Company’s liability to the Customer is limited as follows:
The Company shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of data, or loss of goodwill, arising out of or in connection with the Services.
The Company’s total liability for any claim arising out of a single event or series of connected events shall not exceed the total price paid or payable by the Customer for the Services in question.
The Company shall not be liable for any damage to the Site or property where such damage arises from pre-existing structural weakness, defective materials, poor installation, inherent defects or wear and tear, or where reasonable care and skill have been exercised by the Company.
Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
12. Insurance
The Company maintains appropriate insurance policies in respect of its rubbish removal and waste collection activities, including public liability cover, subject to the terms, conditions, limitations and exclusions of those policies. Evidence of insurance may be made available on request.
13. Force Majeure
The Company shall not be in breach of these Terms and Conditions, nor liable for any delay or failure to perform the Services, where such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include, but is not limited to, extreme weather, natural disasters, accidents, fire, flood, strikes, industrial disputes, traffic incidents, acts of terrorism, war, or changes in law or regulation.
14. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as reasonably possible, providing full details of the issue. The Company will investigate the complaint and seek a fair and reasonable resolution, which may include re-attending the Site, offering a partial refund, or other remedial action where appropriate.
Any claim relating to the Services must be raised within a reasonable period from the date on which the Services were carried out. The Company may not be able to consider complaints made after a prolonged delay, particularly where evidence is no longer available.
15. Data Protection and Privacy
The Company collects and processes personal information in order to manage bookings, deliver the Services, handle payments, and communicate with Customers. The Company will handle such information in accordance with applicable data protection laws and will take reasonable steps to keep personal data secure.
Personal details will not be sold to third parties. They may be shared with trusted partners or service providers where necessary for the performance of the Services, for processing payments, or for legal or regulatory purposes.
16. Amendments to These Terms
The Company may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to Customers, and will apply to future bookings. The version in force at the time of a particular booking will apply to that booking.
17. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but this shall not affect the validity and enforceability of the remaining provisions.
18. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
19. Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation of booking provided by the Company, set out the entire agreement between the Customer and the Company in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions.
By confirming a booking or allowing the Company’s staff to commence work at the Site, the Customer confirms that they have read, understood and agreed to be bound by these Terms and Conditions.
